1. Our App's Core Functionality

"Just Commit" is a mobile fitness accountability application available on iOS for Apple Watch users. The app's core purpose is to motivate users to achieve their health and fitness goals by adding a financial stake to their commitments.

Users create personalized fitness commitments (e.g., "walk 10,000 steps a day for a week") and stake an amount of money on them. The app then uses data from the user's Apple Watch via Apple HealthKit to automatically track their progress.

If the user successfully completes their commitment, they keep their stake. If they fail, their stake is contributed to a community prize pool. Users who are successful in their own commitments and maintain a minimum level of activity become eligible to win a share of this weekly prize pool. The app involves processing payments, handling sensitive health data, and managing user payouts.

2. What Types of Personal Data We Collect

We collect the following types of data to provide and improve our services:
- Account Information:
  - Email address
  - Password (which is hashed and managed by our authentication provider)
  - User-generated statistics (e.g., overall success rate, total money earned/lost)
  - User ID
- Financial Information:
  - Payment credentials via our payment processor, Stripe. We do not directly store your full credit card number; we only store a secure token, the last 4 digits, and the card type for reference.
  - PayPal email address for the sole purpose of sending prize money payouts.
- Health and Activity Information (with your explicit consent):
  - Source: We access this data exclusively from Apple's HealthKit framework, which is populated by your Apple Watch.
  - Data Types: We request access to specific metrics required to verify your commitments, including:

    Distance (walking, running, cycling, etc.)
    
    Active Calories Burned (from workouts)
    
    Workout Duration
    
    Heart Rate data associated with workouts
- Technical and Security Information:
  - Device Security & Integrity Data: We use Apple's App Attest service to generate a token that verifies the integrity of your app and device. This helps us prevent fraud and secure our platform. We store a "trusted" status associated with your account based on these checks.
  - Error Logs: We collect diagnostic and crash reports to identify and fix bugs, which may include technical information about your device and app state at the time of an error.
3. How We Use Your Data (Purpose of Collection)

Your data is used for the following specific purposes:
- To Operate the Core Service:
  - To create and manage your user account.
  - To allow you to create, view, and manage your fitness commitments.
  - To automatically track your progress towards a commitment by comparing your HealthKit data against your goals.
  - To determine if a commitment has been successfully met or failed.
- For Financial Processing:
  - To charge a penalty using Stripe if a commitment is not met.
  - To pay out your share of the weekly prize pool to your PayPal account.
  - To calculate and display your financial stats, such as total money staked, won, and lost.
- For Security and Fraud Prevention:
  - To verify that your device and app have not been tampered with using Apple App Attest.
  - To ensure you are not using multiple accounts on one device to gain an unfair advantage.
  - To secure our backend services and APIs from unauthorized access.
- For Communication:
  - To send you essential service-related emails, such as account verification, password resets, and notifications about your commitments.
- For Analytics and App Improvement:
  - To monitor and analyze app performance, fix crashes, and improve the user experience using aggregated and anonymized data.
4. Who We Share Your Data With (Third-Party Services)

We do not sell your personal data. To provide our service, we rely on the following third-party processors and share data with them only as necessary:
- Supabase: Our backend infrastructure provider. They store our user database, handle user authentication (email/password), and manage our PostgreSQL database.
- PowerSync: A service used to synchronize data between our backend (Supabase) and the local database on your device.
- Stripe: Our payment processor. When you add a card, your payment details are sent directly to Stripe to process penalty charges.
- PayPal: Our payouts processor. We share your PayPal email and the payout amount with them to distribute prize winnings.
- Apple (HealthKit & App Attest): We interface with Apple's services to access health data (with your consent) and to verify device integrity.
- Sentry: Our error and crash reporting service. It helps us identify and fix bugs in the application.
5. Data Retention and Your Deletion Rights

You are in control of your data.
- Data Retention: We retain your personal data for as long as your account is active.
- Account Deletion: You can request to delete your account at any time through the app's settings. Upon request, your account is scheduled for permanent deletion from our systems. This process will erase all your personal data, including account details, commitments, and activity history. If you log back in before the scheduled deletion date, the deletion process is canceled.

1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's health, camera, and other features. If you wish to change our access or permissions, you may do so in your device's settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.

To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.

To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

5. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

6. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If you would at any time like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

7. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

We only collect sensitive personal information, as defined by applicable privacy laws or the purposes allowed by law or with your consent. We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.
Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.
Appeals
Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at jacob@justcommit.app. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.
California "Shine The Light" Law
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?"
